Terms of Service

These Terms of Service ("Terms") govern your use of the services provided by Baarik Travel & Tours Inc. ("Baarik", "we", "us", or "our"), including our website at holidays.baariktravel.ca and any travel services we arrange on your behalf. By engaging our services, you agree to these Terms.

1. Services

Baarik Travel & Tours Inc. is a travel agency that arranges travel on behalf of clients. We act as an intermediary between you and travel service providers (airlines, hotels, cruise lines, tour operators, and others). We do not own or operate these services directly.

Our services include leisure travel planning, destination weddings, corporate retreats, cruise bookings, yacht charters, and bespoke travel experiences.

2. Bookings and Payment

All bookings are subject to availability and the terms and conditions of the relevant travel suppliers. A booking is confirmed only upon receipt of a deposit or full payment as specified in your booking confirmation.

Prices quoted are valid at the time of quotation and may change prior to booking confirmation due to supplier pricing, taxes, or foreign exchange fluctuations. We will notify you of any price changes before confirming your booking.

Full payment is typically required no later than 60 days before departure unless otherwise specified in your booking confirmation.

3. Cancellations and Refunds

Cancellation policies vary by supplier and travel product. When you cancel a booking:

  • Cancellations more than 60 days before departure may be eligible for a full or partial refund, subject to supplier terms
  • Cancellations within 30–60 days of departure typically incur a 50% cancellation fee
  • Cancellations within 30 days of departure are generally non-refundable

Specific cancellation terms for your booking will be provided in your booking confirmation. We strongly recommend purchasing comprehensive travel insurance to cover unforeseen cancellations.

4. Travel Insurance

We strongly recommend that all clients purchase travel insurance covering trip cancellation, medical emergencies, baggage loss, and travel delays. Baarik Travel & Tours Inc. is not responsible for losses or expenses arising from events that travel insurance would typically cover.

5. Passports, Visas, and Entry Requirements

It is your responsibility to ensure you hold a valid passport and any required visas for your destination(s). We provide general guidance on entry requirements, but we do not guarantee the accuracy of this information as requirements can change. You must verify entry requirements with the relevant embassy or consulate before travel.

6. Liability Limitations

Baarik Travel & Tours Inc. acts as an agent for travel suppliers and is not liable for:

  • Acts or omissions of travel service providers (airlines, hotels, cruise lines, etc.)
  • Delays, cancellations, or changes caused by suppliers or circumstances beyond our control (weather, strikes, force majeure)
  • Loss, damage, injury, or illness arising from travel arrangements

Our liability, where it applies, is limited to the fees we have received for arranging your travel. Nothing in these Terms limits our liability for fraud or negligence causing death or personal injury.

7. Changes to Bookings

Requests to change confirmed bookings are subject to supplier approval and may incur amendment fees from the supplier as well as an administration fee from Baarik. Not all bookings are amendable once confirmed.

8. Health and Safety

You are responsible for ensuring you are fit to travel and comply with any health or vaccination requirements for your destination. We recommend consulting a travel health clinic or your physician before travelling to certain destinations.

9. Complaints

If you have a complaint about your travel arrangements, please inform us immediately so we can attempt to resolve the issue. Written complaints must be submitted to holidays@baariktravel.ca within 28 days of your return.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.

11. TICO Registration

Baarik Travel & Tours Inc. is in the process of registering with the Travel Industry Council of Ontario (TICO). Upon registration, clients will be entitled to the consumer protection benefits offered under the Ontario Travel Industry Act, 2002, including access to the Ontario Travel Industry Compensation Fund.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect any changes. Continued use of our services after a change constitutes acceptance of the updated Terms.
